在读博士生EB1A顺利通过

Petitioner is a Ph.D. candidate in the field of glass science. He has 20
papers that have been cited close to 100 times. He also has served as a
referee for over 10 journals and 3 conferences. In addition, he has a patent
from his undergraduate studies. We submitted 7 recommendation letters,
including 5 independent letters in which the referees attested to the use/
reliance of the petitioner’s work in support of their research. In addition
, we submitted a letter from the petitioner’s undergraduate teacher/advisor
who confirmed the petitioner’s critical contribution to the patent. This
letter was accompanied by a statement/letter from the president of a company
that licensed the patent for commercialization. The case was filed using
premium processing and was approved in 13 days.

In preparing the case, I advised the petitioner that analysis on citations
to his papers be performed to show that they are highly cited papers in his
field, and I provided him with relevant samples. The petitioner initially
focused only on his current doctoral studies and related publications. I
advised him to search for evidence on the use of the patent. The petitioner
contacted his undergraduate teacher/advisor and was able to come up with
evidence on the use/commercialization of the patent. This is solid evidence
showing the impact of the petitioner’s work in addition to citations to his
papers, and distinguishes this case from most other cases.

For each recommendation letter, we went through 3 to 6 rounds of review/
revision. Most of the letters not only contain detailed description of the
petitioner’s specific achievements but also examples/testimonies on the use
/application of the petitioner’s work. Here, I would to quote from an AAO
decision to show what the immigration officer looks for in the
recommendation letters: “In evaluating the reference letters, we note that
letters containing mere assertions of widespread acclaim and vague claims of
contributions are less persuasive than letters that specifically identify
contributions and provide specific examples of how those contributions have
influenced the field. In addition, letters from independent referees who
were previously aware of the petitioner through his reputation and who have
applied his work are the most persuasive.”
